These Terms and Conditions ("Terms") govern your use of the Enviro Aqua website and any orders placed through it. By using the site or placing an order you agree to these Terms.

1. Who we are

These Terms govern your relationship with Enviro Aqua (the trading name under ABN 24 638 197 734 / ACN 638 197 734), an Australian-owned business operating from 6/45 Amsterdam Cct, Wyong NSW 2259.

2. Orders and acceptance

Placing an order on the site is an offer to purchase. We accept the offer when we dispatch the goods and send a shipping confirmation email. Until that point we may decline the order — for example, if the product is out of stock, the price was listed incorrectly due to a system error, or we cannot verify the payment.

If we cannot fulfil an accepted order for any reason, we will refund the order in full and contact you to explain.

3. Pricing and GST

All prices on the site are in Australian dollars (AUD) and include GST where applicable. The price displayed at checkout is the price charged.

We try to keep pricing accurate, but errors do happen. If a product is listed at a clearly incorrect price (typically a price that is materially below cost), we may decline the order rather than fulfil it. Any payment taken in error will be refunded in full.

Prices may change without notice. The price you pay is the price displayed at the time the order is placed.

4. Payment

Payments are processed by Shopify Payments and the supported third-party payment providers (credit card, Apple Pay, Google Pay, Shop Pay). We do not store payment card details on our systems — Shopify handles payment processing in compliance with PCI DSS.

5. Shipping

Shipping terms, dispatch times, and delivery estimates are set out on the Shipping page. Shipping estimates are not guarantees; we are not liable for carrier delays outside our control.

Risk of loss passes to you on delivery to the address you specified.

6. Returns and warranty

Returns and warranty terms are set out on the Returns page. Nothing in these Terms reduces your rights under the Australian Consumer Law.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

7. Use of the site

You agree not to:

  • Use the site to transmit unlawful, harmful, or malicious content.
  • Attempt to access areas of the site that are not publicly available.
  • Use automated tools to scrape, copy, or duplicate the catalogue without our written consent.
  • Interfere with the operation of the site or attempt to bypass security.

We may terminate access for users who breach these Terms.

8. Intellectual property

All content on the site — text, images, product photography, layout, code — is owned by Enviro Aqua or our suppliers. You may not reproduce, distribute, or create derivative works without our written consent. You may share links to product pages and editorial content freely.

Product images supplied by manufacturers remain the property of the respective manufacturers and are used with permission.

9. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from your use of the site or our products is limited to the price you paid for the affected product. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or business interruption.

Nothing in this clause limits liability that cannot be excluded under the Australian Consumer Law or other applicable law.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of NSW, Australia.

11. Changes to these Terms

We may update these Terms from time to time. The current version is dated below. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
